Kausik CRM (M) 2272 of 2025 In Re: An Application for bail under section 439 (1)(b) of the Code of Criminal Procedure 1973/Section 483 (1) (b) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Mr. Banerjee, learned senior advocate appearing on behalf of the petitioner submits that the father of the petitioner has expired and presently the mother has been hospitalized. In case the mother of the petitioner is hospitalized, petitioner will take out an application before the learned Trial Court. Learned Trial Court will direct the Jail Authorities for the petitioner to visit her hospitalized mother with proper escort. It would be the exclusive discretion of the Trial Court on the second occasion, if any such application is preferred to take into account the urgency of the situation so far as the medical health of the mother of the petitioner is concerned and allow such visit.

So far as the trial of the case is concerned, the petitioner and the State are at loggerhead while the petitioner submits that the State has been delaying the trial. On the other hand

State submits that it is the accused persons who are delaying the process of trial.

Be that as it may, it is submitted on behalf of the prosecution that two Investigating Officers as well as another witness is left out to be examined. The witness who is on dock, her cross-examination should be completed by 14.12.2025. So far as the rest of the 2 witnesses are concerned, the examination-in-chief and the cross-examination be completed by 31.01.2026.

The examination under Section 313 of the Cr.P.C. be completed by 28.02.2026. If the defence do not intend to tender any witness, the learned Trial Court will commence the argument on and from 01.03.2026. However, in case the defence intends to cross-examine, another 30 days be granted to the defence/accused persons, learned Trial Court would deliver the verdict of the case by 30.04.2026. With the aforesaid observations CRM (M) 2272 of 2025 is dismissed.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
