1. Parties are represented through their respective learned counsels.

2. At the time of hearing, learned counsel appearing on behalf of petitioners, at the very outset, submits before this Court that for the present he is only pressing Prayer - C of the instant writ petition, which is a prayer for issuing appropriate writ/writs against the respondent authorities to take appropriate steps on the basis of the representation as submitted by the writ

petitioners, a copy of which has been annexed at Page Nos.87 to 93 of the instant writ petition.

3. It is further contended that on the basis of such representation, the Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas has issued a notice dated 24.02.2025 to all the stake holders, however, the proceeding as has been initiated on the basis of said notice dated 24.02.2025 has not come to a logical conclusion.

Learned counsel appearing on behalf of the private respondents, in his usual fairness, however, submits that no prejudice would be caused, in the event, Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas is directed to conclude the proceeding, as has been issued in terms of the notice dated 24.02.2025, within a fixed time period.

5. Learned counsel for the respondent/State submits before this Court that Sub-Divisional

Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas is not a party.

6. At this stage, learned counsel for writ petitioners seeks liberty to add the Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas as a party respondent by making necessary insertion in the cause title of the instant writ petition.

7. Leave, as prayed for, is hereby granted.

8. Learned counsel for writ petitioners is directed to add Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas as party respondent no.16 in course of this day in Court by making necessary insertion in the cause title of the instant writ petition.

9. On a careful perusal of the entire materials on record, as placed before us and after giving due adherence to the submissions of the learned counsels for the contending parties, we while disposing of the instant writ petition directs the Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas to come to

a logical conclusion in respect of the proceeding, as has been initiated by him by issuing notice dated 24.02.2025.

We further direct the concerned Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas to give due opportunity of hearing to all the stake holders including the writ petitioners and the private respondents and thereafter shall pass a reasoned order and shall forthwith communicate the same to the writ petitioners, private respondents and the other stake holders, if there be any.

11. The entire exercise, as indicated hereinabove, shall have to be completed by the Sub-Divisional Land & Land Reforms Officer, Diamond Harbour, South 24 Parganas within 60 working days from the date of communication to the server copy of this order.

12. Liberty is given to learned advocate on record for writ petitioners to communicate the server copy of this order to the Sub-Divisional Land & Land

Reforms Officer, Diamond Harbour, South 24 Parganas for his compliance.

13. Since affidavits have not been called for, the allegations, as made in the instant writ petition, be deemed to have been denied.

14. With the aforementioned observation, W.P.A. (P) 485 of 2025 stands disposed of.

15. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
