The learned advocate appearing for the petitioner submits that the private respondent has been duly served.
In spite of service none appears to oppose this writ petition.
On the prayer of the learned advocate on record of the petitioner, the Block Land and Land Reforms Officer, Tamluk -I, Purba Medinipur is added as a party respondent in this writ petition.
The learned advocate on record of the petitioner is granted leave to amend the cause title of this writ petition, here and now.
Since the State is represented by its learned advocate there is no necessity to cause service of this writ petition upon the added respondent. However, the learned advocate on record of the petitioner shall be obliged to serve a copy of the amended cause title of the writ petition upon the learned advocate for the State forthwith.
The petitioner claims to be the owner of plot no. 227 measuring about 3 decimals within Mouza Ratnaly, J.L. No. 138 under Police Station Tamluk in the District of Purba Medinipur. The petitioner states that there is a PWD road adjacent to the property of the petitioner and the private respondent has made an illegal and unauthorised construction on the PWD road thereby causing obstruction to the ingress and egress of the petitioner from his property to the PWD road. The petitioner submitted a representation dated September 22, 2025 before the Assistant Engineer, Public Works (Roads) Department, Tamluk Highway Sub-Division. The learned advocate appearing for the petitioner submits that in spite of receipt of such representation no steps have been taken by the respondent authorities to remove the encroachment from the PWD roads.
The learned advocate appearing for the State submits that immediately upon receipt of the representation dated September 22, 2025 the Assistant Engineer, Public Works (Roads) Directorate, Tamluk Highway Sub-Division, Purba Medinipur being the 3rd respondent has requested the Block Land and Land Reforms Officer, Tamluk-I to demarcate the road side Government plot in front of L.R. Plot No. 227 of Mouza Ratnaly by the side of Mecheda Tamluk road in the District of Purba Medinipur. He submits that the work of
demarcation shall be completed within a period of six weeks from date.
In the light of the submissions made by the learned advocates for the respective parties, the Block Land and Land Reforms Officer, Tamluk -I, Purba Medinipur being the added respondent is directed to complete the work of demarcation and to prepare a sketch map which shall be forwarded to the Assistant Engineer, Public Works (Roads) Directorate, Tamluk Highway Sub-Division, Purba Medinipur being the 3rd respondent within a period of four weeks from the date of receipt of a server copy of this order. Immediately upon receipt of the report from the concerned Block Land and Land Reforms Officer, the 3rd respondent shall take necessary steps in terms of the provisions laid down under Section 10 of the West Bengal State Highways Act, 1964 and ensure that the entire exercise is completed within a period of four weeks from the date of receipt of a copy of the report from the concerned Block Land and Land Reforms Officer. With the above observations and directions, WPA 25386 of 2025 stands disposed of.
There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
