Present petition has been filed for expeditious disposal of C-3080 of 2023 proceeding under Section 12 of the Protection of Women from Domestic Violence Act, 2005 pending before the learned 4th Judicial Magistrate South 24 Parganas, Alipore.

Learned counsel for the petitioner submits that the proceeding were filed on 10th November, 2023 and till date despite appearance of the opposite parties the matter has not been taken up for hearing by the learned Court. Learned counsel for the petitioner has referred to Section 12 of the Domestic Violence Act which mandates for expeditious disposal.

Taking into account the submissions of the learned counsel for the petitioner and Section 12 of the Domestic Violence Act the matter is disposed of with

a direction to the learned 4th Judicial Magistrate, South 24-Parganas/officiating magistrate to dispose of the matter expeditiously after giving sufficient opportunities to the opposite party of being heard in accordance with law.

Ms. Trina Mitra, learned advocate who generally represents the State in other matters is requested to convey the order to the office of the learned Public Prosecutor.

The petition is disposed of.
