Kausik (Allowed) CRM (NDPS) 1420 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliyaganj Police Station Case No. 31 of 2025 dated 20.01.2025 under Section 22(c) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 10 months and the seizure which has been effected in this case of 75 bottles of Phensedyl which is from the exclusive possession of the petitioner. It has been contended on behalf of the petitioner that although charge sheet has been submitted and charge has been framed but till date no witness has been examined. Although 19 witnesses have been examined by the prosecution. Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of Phensedyl was recovered from the custody of the present petitioner and the prosecution witnesses are ready for taking the trial of the case to its logical conclusion.

I have taken into account the period of detention of the petitioner and having regard to the same, I am of the view that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Dasrat Barman shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of the learned Special Judge (NDPS), Raiganj, Uttar Dinajpur.

If on bail the petitioner will be physically present on each and every date fixed before the learned Special Court and shall not leave the jurisdiction of Uttar Dinajpur without prior intimation to the learned Special Court.

Accordingly, CRM (NDPS) 1420 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
