The present appeal from the order of 30th July, 2023 has become infructuous in view of the changed circumstances arising between the parties. The look out Circular which was not the subject matter of challenge initially, was later included at the time of hearing of the petition, since it was brought on record by the appellant, in its pleadings in the affidavit-in-opposition filed to the writ petition, as appears from the impugned order (paragraph 3).

Counsel for both the parties admit that the look out circular has lost its force.

In view of the aforesaid, the instant appeal and the connected application are dismissed as infructuous. There shall, however, be no order as to costs. (Reetobroto Kumar Mitra, J.) (Tapabrata Chakraborty, J.)
