Learned advocate appearing for the petitioner submits that from the possession of the petitioner 169 bottles of phensedyl were recovered and the petitioner since such seizure is in custody for 1 year and 5 months and till date the prosecution has not been able to overcome the stage of consideration of charges.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the period of detention of the petitioner and on an assessment of the same, I am of the view further detention of the petitioner is unwarranted. Accordingly Petitioner, namely, Tufan Mandal shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each.
One of whom must be local to the satisfaction of the learned Additional District Judge, 3rd Court, Special Court, Malda. If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of the District of Malda without prior permission from the learned Special Court.
Accordingly, CRM (NDPS) 1421 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
