Re : CRAN 1 of 2023 The reasons so assigned in the revisional application for condonation of delay are justified and sufficient. Accordingly, the delay is condoned and CRAN 1 of 2023 is allowed. Petitioner is aggrieved by the quantum of maintenance awarded in the order 17th March, 2023 by the Learned Judicial Magistrate, 7th court, Asansol, Paschim Burdwan in Misc. Case No. 28 of 2020. The order so passed is by way of interim order of maintenance and the trial of the main case is still pending. Record reflects that the foundation of the said order was that the husband is CRPF who is a constable. Learned advocate for the present petitioner/husband submits that there are liabilities of the present petitioner including expenses.

In view of such submissions advanced on behalf of the petitioner, liberty is granted to the petitioner to file an application under Section 127 of the Code of Criminal Procedure. Learned Magistrate on such application being filed after issuing notice to all

the parties would dispose of the same within a period of three months of filing of such application.

With the aforesaid observations, the present revisional application being CRR 4154 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
