Mr. Mukteswar Maity Ms. Manika Sarkar ..for the Petitioner Ms. Jayeeta Sinha Mr. Sandip Mandal ....for the State Mr. Sandipan Banerjee Mr. Sundar Gopal Bhattacharya ...for the KMC Affidavit of service filed by the petitioners and report submitted by the State are taken on record. The petitioners allege that though they are the owners of the house in question, they are restrained from entering therein by the private respondents. Several complaints lodged by the petitioners in this regard were not considered.

Learned counsel for the State submits that pursuant to the complaint lodged by the petitioners, specific case has been started and investigation is in progress.

In view of the above, the police authority is directed to conduct fair, unbiased and impartial investigation and take the same to its logical conclusion in accordance with law.

Since the petitioners are apprehend threat to their life and property at the behest of the private respondents, the police authority shall render necessary assistance/protection to the petitioner as and when sought and shall also keep strict vigil in the area in view of strained relationship between the parties. The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
