Tapas Bose And ANR v. Binoy Roy
AD-61 Ct No.16 17.01.2025 (SSS) CO 3700 of 2024 Sri Tapas Bose and Anr.
Vs.
Binoy Roy Mr. Manoranjan Mahata, Mr. Amit Bikram Mahata ....For the Petitioners.
1. In view of the innocuous nature of the order proposed, no prior service of notice is directed on the Opposite Parties.
2. The grievance of the plaintiffs/petitioners in an eviction suit is that the suit has been kept pending since long. The petitioners seek early disposal of the same.
3. However, although the present suit was filed in the year 2021, much older suits are pending in the concerned court. When posed with such question, the plaintiffs submit that excessively long dates are being fixed for hearing of the suit.
4. In fact, the last date was fixed on December 5, 2024 after a long gap of eight months.
5.
Keeping in view the implicit urgency in an eviction suit and the long dates being fixed, CO 3700 of 2024 is disposed of with a request to the learned
Civil Judge (Junior Division), First Court at Barasat, District - North 24 Parganas to dispose of Title Suit No. 767 of 2021, pending before it, as expeditiously as possible, positively by June 30, 2026.
6.
There will be no order as to costs.
7.
The parties and all concerned shall act on the server copy of this order without insisting upon prior production of any certified copy for the purpose of compliance.
