Learned advocate for the petitioner submits that issue involved in this writ petition relates to transfer on the ground of distance. It has been submitted that transfer application of the petitioner was forwarded by the concerned District Inspector of Schools to the office of the West Bengal Central School Service Commission on 29th April, 2022. Petitioner prays for necessary direction upon the Commission to take decision on transfer application of the petitioner.

The Commission and State respondents are represented by the learned advocates who

have jointly submitted that transfer application of the petitioner perhaps could not be decided due to suspension of Utshasree portal.

However, on behalf of the Commission it is submitted that in the event direction is given upon the concerned authority of the Commission appropriate steps shall be taken in accordance with law.

Having considered the submissions made on behalf of the parties, the writ petition is disposed of by directing the Chairman, West Bengal Central School Service Commission being the respondent no. 4 to take decision on transfer application of the petitioner by four weeks from the date of communication of this order. The decision to be taken by the respondent no. 4 shall be communicated to the petitioner by one week thereafter.

The respondent no. 4 shall not reject the transfer application of the petitioner on the ground of suspension of Utshasree portal.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
