This application under Article of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Barasat to dispose of Title Suit No.800 of 2021 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Trial Judge. From the order-sheets appended to this revisional application, this Court finds that the 11th of November, 2024 was fixed for hearing of the petition dated 30th May, 2023. On a query, the learned Advocate appearing for the petitioner could not apprise this Court as to whether what is the application which was filed on 30th of May, 2023.

Learned Advocate also could not apprise whether the same is still pending or not.

C.O. 3708 of 2024 stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Barasat, District-North 24 Parganas to take up the hearing of the application dated 30th May, 2023, if the same is still pending and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

Considering the facts that the suit is for eviction under the provision of Section 6 of the West Bengal Premises Tenancy Act, the learned Trial Judge is requested to make an endeavour to dispose of the interlocutory application as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

After disposal of the interlocutory application, the learned Trial Judge is further requested to make an endeavour to see that the Title Suit No.800 of 2021 is disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

With the above observation, C.O. 3708 of 2024 stands disposed of

There shall be no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
