Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been implicated only on certain doubts of the defacto-complainant. It has also been submitted that one of the accused has been granted bail in connection with the instant case and the petitioner is similarly situated as the said person who has been granted bail.
Learned advocate for the State produces the case diary and opposes the prayer for bail and submits that the investigation of the case is in progress and the police authorities are exerting their efforts for tracing out one
absconding accused and the petitioner happens to be the husband of the deceased.
Learned advocate for the defacto-complainant is present and also opposes the prayer for bail.
In view of the investigation of the case still continuing at this stage I am not inclined to release the petitioner on bail. Petitioner would be at liberty to renew the prayer for bail at the appropriate stage.
Accordingly, CRM (M) 2275 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
