The petitioners have approached this Court assailing an order dated 19th September, 2022 passed by the learned Sessions Judge, Malda issuing warrant of arrest against them. At the time of initial hearing it is candidly submitted by the learned Advocate for the petitioners that they will voluntarily surrender before the Trial Court within the period of time as fixed by this Court. They had no intention to violate the conditions for bail. However, most of the petitioners work as day labourers at Mumbai and on the date of hearing they could not appear before the Trial Court. One of the petitioners could not appear before the Court below due to his illness.

Considering the submissions made by the learned Advocate for the petitioners that they are inclined to surrender voluntarily before the Trial Court, the operation of the order dated 19th September, 2022 be stayed for a period of three weeks.

The petitioner Nos.2 to 5 are directed to surrender voluntarily in the Trial Court within two weeks from the date of communication of this order. On their voluntary surrender, it is expected that the learned Sessions Judge, Malda will consider their prayer for bail, if any, in accordance with law.

In view of the above order, nothing remains in the instant revision and accordingly, the same is disposed of. (Bibek Chaudhuri, J.) Mithun De/ A.R. (Ct).
