Affidavit-of-service filed in Court today are taken on record.

The Officer-in-charge, Ekbalpur Police Station has filed a report in the form of instructions addressed to the State Advocate dated 19th January, 2023. The same is taken on record.

It is submitted that the police has contacted the petitioners repeatedly in respect of FIR No. 419 of 2022 dated 10th September, 2022 to give statement under Section 164 of the Code of Criminal Procedure but in vain.

Counsel for the petitioners submits that his clients were in hospital at the relevant point of time. Be that as it may, with a view to end this impasse, this Court directs the petitioners' statement under Section 164 of the Code of Criminal Procedure to be recorded by the jurisdictional Magistrate on Saturday i.e. 28th January, 2023 at 2:00 P.M.

It is further ordered that the investigation into the FIR No. 419 of 2022 dated 10th September, 2022 and FIR No. 410 of 2022 dated 7th September, 2022 be completed as expeditiously as possible, preferably within a period of one month from date.

It is also submitted that the private respondents are co-operating with the investigation.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

The concerned Magistrate shall act on the server copy of this order.
