Learned advocate appearing for the petitioner submits that the petitioner is innocent and falsely implicated in connection with the instant case. It has been contended that the petitioner being driver was apprehended along with the Khalasi. The owner of the vehicle, according to the petitioner, has already been released on bail. Additionally it has been submitted that the petitioner is in custody for more than four years.

Learned DSGI appearing for the Customs authority opposes the prayer for bail and submits that three more witnesses are left to be examined.

In view of the present stage of the case and the fact that 14970 bottles of phensedyl having been recovered, I am

of the view that a last opportunity be given to the Customs authority. The prosecution would complete their evidence within three months from the next date so fixed. In case the prosecution is unable to conclude the trial, the learned Trial Court would release the petitioner on bail on such terms and conditions as it deems fit and proper. With the aforesaid observations, the application for bail, being CRM (NDPS) 1419 of 2025, is disposed of. Learned Registrar General, High Court, Calcutta is directed to communicate this order to the learned Trial Court.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
