Kausik CRM (M) 2279 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Pathar Pratima Police Station Case No. 294 of 2022 dated 07.10.2022 under Section 376(2)(n)/506 of the Indian Penal Code, 1860 and Section 6 of the NDPS Act, 2012.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 3 years and till date the trial has not been completed in spite of earlier directions by this Court.

Learned advocate for the State submits that out of 13 witnesses proposed to be examined by the prosecution, 9 witnesses have already been examined. Having regard to the same, I direct the learned Trial Court to conclude the trial within a period of 6 months from the next date so fixed. In case the trial is not concluded within next months, learned Trial Court would release the petitioner on bail. Accordingly, CRM (M) 2279 of 2025 is disposed of.
