Mr. Sayan Chattopadhyay, Mr. Ayanava Acharya, Ms. Suparna Jana, Ms. Manisha Saha ...for the Petitioner Mr. Sibojyoti Chakraborti, Ms. Indrani Lahiri ...for Zilla Parishad The petitioner submits that a room measuring approximately 508 sq. ft. at the Bagnan Shopping Complex was leased to it for office use in 2009 for a period of five years. The lease was renewed from time to time. However, when the petitioner last applied for further renewal on November 14, 2024, the application was rejected by respondent no. 3 by a letter dated September 22, 2025. Learned counsel for the petitioner submits that the decision not to renew the lease was taken without properly affording the petitioner an opportunity of hearing. Learned counsel appearing for the Zilla Parishad submits that the Zilla Parishad requires the room in question for its own use, and therefore resolved not to renew the lease. There is limited scope for interference by the Writ Court in this matter. However, it is noted that the petitioner's lease had been renewed on multiple earlier occasions.

In view of the above, this Court directs the Howrah Zilla Parishad to afford the petitioner an opportunity of hearing and thereafter pass a reasoned order on the issue of renewal of the lease, and to communicate such order to the petitioner. The entire exercise shall be completed within one month from the date of communication of this order. Accordingly, WPA 25469 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
