Order dictated by Arijit Banerjee, J.

1. From the report filed by the CBI on the last occasion, we find that the petitioners have been complying with the conditions of interim bail. However, it appears that on November 4, 2024, the petitioners failed to appear before the learned Trial Court.

2. Learned advocate for the petitioners says that November 4, 2024, was the first day after the Puja Vacation and due to some difficulty, the petitioners could not be present before the learned Court but a petition under Section 317 Cr.P.C. (Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023) was filed before the learned Trial Court.

3. Therefore, in our opinion, it cannot be said that the petitioners were trying to flee away from the course of justice. Otherwise they have been complying with the terms and conditions of the interim bail. There is no possibility of an early conclusion of the trial.

4. Therefore, we are inclined to confirm the order of interim bail on the same terms and conditions on which we had granted interim bail to the petitioners and we do so.
