Case No.848 of 2025 dated 26.10.2025 under Sections 126(2)/329(3)/115(2)/110/117(2)/351(2)/ 79/3(5) of the BNS.

Durga Rani Das Bhowmik @ Durga Das Bhowmik and others ... petitioners Mr. Arnab Chatterjee Mr. Avik Ghosh Mr. Abhinaba Mukherjee ... for the petitioners Mr. Arijit Ganguly Mr. Tirthankar Dhali ... for the State Learned counsel for the petitioners submits that a scuffle took place between two groups of villagers. No grievous injury was caused.

Learned counsel for the State opposes the prayer for anticipatory bail and refers to the injury reports and the statements of witnesses.

It appears that one of the victims is a minor girl. It also appears that on a particular date the accused had come and assaulted the victims. Over the issue of lodging complaint before the police, they again came and assaulted the victims. Considering the serious nature of allegations and the materials available in the case diary and the fact that the petitioner Nos.1, 5 and 7 are ladies, while I am inclined to

grant anticipatory bail to the petitioner Nos.1, 5 and 7, the application for anticipatory bail of the petitioner Nos.2, 3, 4, 6 and 8 (Srimanta Bhowmik, Sibu Das, Arun Kumar Das, Barun Das and Kshudiram Das @ Khudiram Das) is rejected. In the event of arrest, the petitioner Nos.1, 5 and 7 (Durga Rani Das Bhowmik @ Durga Das Bhowmik, Santilata Bhowmik Das @ Santilata Das and Kabita Das) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner Nos.1, 5 and 7 shall cooperate with the investigation and shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
