Kausik (Rejected) CRM (M) 2315 of 2025 In Re: An Application for bail under section 439 of the Code of Criminal Procedure 1973/Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tarakeswar Police Station Case No. 89/2025 dated 13.03.2025 under section 137(2)/140(3) of the Bharatiya Nyaya Sanhita, 2023 under Sections 137(2)/140(3)/64(2)(m)/115(2)/351(3) and Section 6(1) of the POCSO Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 164 days and the investigation having been concluded in the background of the facts of the present case the petitioner may be released on bail. Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement under section 164 of Cr.P.C. It has been informed that the evidence is yet to commence. It has been informed that presently the case is at the stage of supply of copies. Learned Special Court would expedite regarding the steps to be taken.

Petitioner would be at liberty to approach this Court after the evidence of the victim girl is over preferably within a period of 3 months from date.

At this stage, CRM (M) 2315 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
