Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner had given a loan to the accused in 2010. The same was not returned. The petitioner made a complaint before the Officer-in-Charge of Parnasree Police Station on 07.06.2021 regarding the non-payment of loan. On 17.02.2022, Paranasree Police Station Case No. 50 dated 17.02.2022 was registered. A charge sheet was submitted on 14.07.2022. But, the defacto-complainant was not made aware by the learned trial Court about what happened thereafter.

Learned counsel appearing on behalf of the State relies on the report and submits that a charge sheet has already been submitted.

This is quite clearly not a case of police inaction. It is for the petitioner to exercise discretion as to whether to participate in the matter before the Criminal Court or not.

Therefore, no further order need be passed in this regard.

The writ petition is disposed of without any costs. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.. (Jay Sengupta, J.)
