Petitioner has prayed for release of the vehicle which is subject matter of Kalyani Police Station Case No. 340 of 2022 dated 24.06.2022. Two reports have been submitted. One by the Inspector-in-Charge, Kalyani Police Station and another by the Investigating Officer of DDI Nadia, CID, West Bengal. Report reflects that the petitioner's signature according to the report of the expert did not match. Consequently I do not find any case for interference at this stage as the investigation of the case is in progress, particularly with regard to the prayer advanced in the writ petition.

Petitioner will be at liberty to approach the jurisdictional Court in seisin of Kalyani P.S. Case No.340 of 2022 dated 24.06.2022 for return of the vehicle. Learned Court would assess regarding the genuinity of the claim and thereafter pass necessary orders.

Report submitted in Court be kept with the record.

With the aforesaid observations, the writ petition being WPA 26038 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
