The petitioner is aggrieved by the pace of investigation into FIR No. 259 of 2022 dated 01.10.2022 under Section 380 of the Indian Penal Code of Thakurpukur Police Station. Section 457 of the Indian Penal Code was subsequently added. In course of investigation, if it is found that the accused persons have committed other offences, the Investigating Officer of the case shall be at liberty to add other sections in the FIR without having approached the Magistrate.

The investigation into the subject FIR must be completed mandatorily and positively within one month from date.

With the aforesaid directions, the instant writ petition shall stand disposed of.

The instructions of the Officer-in-charge, Thakurpukur Police Station in the form of a report dated 24th November, 2022 addressed to the Government Pleader, High Court, Calcutta be taken on record.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
