Learned advocate for the petitioner submits that the petitioner booked a car by paying an advance of Rs.10,000/-. But, he was cheated inasmuch as no such car was made available. The accused are threatening the petitioner and his family members and they are trying to flee the country.

Learned advocate for the State relies on the report and submits as follows. On the complaint of the petitioner, a specific FIR has been lodged. Notice was served under Section 41A of the Code to the accused. The investigating officer is trying to obtain the necessary CCTV footage and recover the money. The statements of the relevant witnesses have been recorded.

It appears that the investigation is going on.

The investigating agency shall conclude the investigation expeditiously and in accordance with law. However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. With these observations, the writ petition is disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
