Petitioners are similarly placed as accused person who has been granted bail. Learned Sessions Judge, Malda has granted bail on 11.09.2025 to one Kamiruddin Momin who is the other accused in the case and also from his joint possession there were recovery of FICN. Petitioners are in custody for about 1 year 3 months.

Having regard to the fact that there has been no application for cancellation of bail on behalf of the State and the petitioners are similarly placed as the other accused person who has been granted bail, I am inclined to release the petitioners on bail.

Accordingly, the prayer for bail of the petitioners is allowed. The petitioner no.1, namely, Aresh Ali @ Waresh Ali and

the petitioner no.2, namely, Akhtarul Jaman @ Raj shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Malda. If on bail, the petitioners shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Malda without the prior permission of the learned trial court.

Accordingly, CRM(M) 2283 of 2025 is allowed.
