Rakib (Allowed) CRM (M) 2281 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ballygunge DD Police Station Case No. 01 of 2022 dated 08.01.2022 under Sections 120B/387 of the Indian Penal Code, 1860 and Sections 25/27 of the Arms Act, 1959.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for three years and eleven months and out of the 67 witnesses proposed to be examined only 4 witnesses till date has been examined by the prosecution.

Considering the progress of the case this Court directed to furnish a report as to whether the present petitioner has any antecedents or not.

Report has been submitted by the investigating officer that the present petitioner has no antecedents. Let the report be kept with the record.

Having considered the complicity of the present petitioner, the period of detention and the fact that other accused persons have been granted bail, I am of the view that further detention of the petitioner is unwarranted. As such the petitioner namely, Avinash Rout @ Avinash Kumar Rawat shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Alipore.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned trial Court. The petitioner shall not leave the jurisdiction of Kolkata Municipal Corporation without the leave of the learned trial Court. Accordingly, CRM (M) 2281 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
