Ashraf Ali Mondal And ORS. v. State Of West Bengal
28/11/2025 D/L - 107 Court No.28 S. Kundu Rejected C.R.M.(A) 3785 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Onda P.S case no. 249 of 2025 dated 3.10.2025 under Sections 329(4)/115(2)/117(2)/303(2)/324(4)/326/351(3)/79/3(5) of the BNS.
In the matter of: Ashraf Ali Mondal & Ors.
...Petitioners.
Mr. Samiran Mondal Mr. Nitish Samanta Mr. Abhinaba Dan Ms. Shreyeashee Mitra ...for the petitioners.
Mr. Aniket Mitra Mr. Dipankar Paramanick ...for the State.
1. Learned counsel appearing for the petitioners submits as follows. The petitioners have been falsely implicated in this case. Earlier, a case was started from the side of the petitioners against the de-facto complainant and others. In retaliation, the de-facto complainant party must have set their own house on fire to falsely implicate the petitioners.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the statements of the victims and the neighbours. He also relies on seizure list for seizure of burnt articles, photographs and injury reports.
3. Considering the serious nature of allegation and the incriminating materials available in the case diary, I do
not consider this to be a fit case to grant anticipatory bail to the petitioners.
4. Accordingly, the application for anticipatory bail is rejected.
5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
