Mr. Samaruddha Das ..for the Petitioner Mr. Asish Kumar Guha Mr. Naren Ghosh Dastidar ....for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. None appears for the private respondent despite service.

The petitioner alleges that the private respondent who is a tenant under him in the premises in question has kept the premises under lock and key despite the agreement for tenancy having expired. The petitioner approached the police authority for eviction of the private respondent and recovery of possession which has not been considered.

It appears that the private respondent is a tenant in respect of the premises in question under the petitioner. Since the petitioner alleges that the private respondent has kept the premises under lock and key despite expiry of the period of tenancy, he is at liberty to approach the appropriate civil forum for redressal of his grievance.

Nothing further remains to be dealt with in the writ petition. The same is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
