Learned advocate for the petitioner submits that the petitioner is in custody for more than 1 year and similarly placed accused persons have been released on bail. Mr. Ranabir Roy Chowdhury, learned senior advocate appearing for the State submits that there are materials against the present petitioner and he was absconding for a considerable period of time. However, learned advocate for the State is unable to satisfy as to how the petitioner is differently placed than other accused persons who have been granted bail. Having considered that similarly placed accused persons have been granted bail, the same privilege is extended to the present petitioner.

Consequently, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner, namely, Manirul Hoque @ Masidur @ Manir @ Manua shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of CJM, Malda.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court. Petitioner shall not leave the jurisdiction of District of Malda without the permission of the learned Trial Court.

Accordingly, CRM (M) 2285 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
