WPA 25175 of 2025 (Ganesh Shaw vs. State of West Bengal & Ors.) Mr. Antarikhaya Basu Mr. Moyukh Mukherjee Ms. Sarmistha Basak .... For the Petitioner Mr. Ashim Kr. Goswami Ms. Jayeta Mitra (Kundu) .... For the State Supplementary affidavit filed by the petitioner and the report submitted by the State are taken on record. It appears from the report that statement of eye witnesses has been recorded under Section 183 of the BNSS in course of investigation. During search of CCTV footage of the alleged incident it was found that there was CCTV surveillance system in three shops surrounding the place of occurrence. But the place of occurrence is not covered by any of the said CCTV cameras.

However, learned counsel for the State candidly submits that if the petitioner is in a position to assist the investigating agency by providing any CCTV which may cover the place of occurrence, the investigating agency will act accordingly. It also appears that despite search and raids conducted by the investigating agency, other accused persons could not be apprehended. Investigation is in progress. Investigating agency is directed to conduct investigation in a fair, proper, unbiased and impartial manner and take the same to its logical conclusion in accordance with law.

The police authority shall keep strict vigil over the area in order to avoid any untoward incident and to ensure

maintenance of law and order. The police authority shall render adequate protection to the petitioner as and when sought.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
