Kausik (Allowed) CRM (M) 2286 of 2025 In Re: An Application for bail under section 439 of the Code of Criminal Procedure 1973/Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Goalpokher Police Station Case No. 530 of 2023 dated 21.09.2023 under section 302/212/120B of the Indian Penal Code, 1860 read with section 25(i)(a)/27 of the Arms Act.

Petitioner is in custody for 2 years and 2 months and learned advocate for the petitioner submits that out of 35 witnesses proposed to be examined only 21 witnesses have been examined. 14 witnesses are yet to be examined by the prosecution.

It has also been pointed out that with progress of evidence in the case there has been complete deviation from the initial case made out in the charge sheet.

Learned advocate for the State has submitted a status report in respect of the present case.

I have also considered the earlier order passed by a Coordinate Bench in respect of Md. Gulam Mustafa @ Gulam Mustafa @ Baba in CRM (DB) 486 of 2025. Having considered the locus of the present petitioner compared to that of the person who has been released on bail, I am inclined to release the petitioner on bail.

Petitioner, namely Debendar Paswan @ Bhajan Paswan shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of the learned CJM, Uttar Dinajpur.

If on bail the petitioner shall be physically present as and when the dates are fixed by the learned Trial Court. Petitioner shall not leave the jurisdiction of Uttar Dinajpur without the leave of the learned Trial Court. Accordingly, CRM (M) 2286 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
