1. Affidavit of service filed in Court is taken on record.

2. Sufficient grounds are available to explain the delay of 13 days in filing the instant appeal. Hence, the delay is condoned.

3. Accordingly, CAN 1 of 2025 is allowed and disposed of.

Re: MAT 1926 of 2025 1.

The instant appeal is directed against an order dated 26.08.2025 passed by the Single Bench of this Court. By the said order the trial judge directed the Howrah Municipal Corporation (HMC) to consider the representation of the writ petitioner/appellant.

The grievance of the writ petitioner/appellant is that the private respondent has constructed a G+5 storied building against the sanctioned plan of G+2 issued by the concerned Borough of the HMC.

The learned counsel for the respondents submits that pursuant to the trial court's order, the concerned Borough of the HMC has ordered demolition of the unauthorized construction. The said order of the HMC has been challenged in the fresh writ petition being WPA 29428 of 2025.

In that view of the matter, nothing further remains to be adjudicated in the instant appeal.

Accordingly, MAT 1926 of 2025 is disposed of. Consequently, connected pending application being CAN 2 of 2025 is also disposed of.

The appellant may urge his grievance in the new writ petition in which he has been impleaded as party respondent.

There will be no order as to costs.
