Allowed that there has been no recovery from the present petitioner and he has been implicated in connection with the instant case on the basis of the statement of a co-accused.
Learned advocate for the State opposes the prayer for bail and submits that there are criminal antecedents of the present petitioner.
Be that as it may, since the petitioner has been implicated and is detained in custody for the last 52 days only on the basis of the statement of a co-accused, I am inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner namely, Pijush Mandal shall be released on
bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, (under NDPS Act), Malda. If on bail, the petitioner shall not leave the jurisdiction of Kaliachak Police Station without informing the learned trial court. Petitioner shall be physically present on each and every date fixed by the learned trial court. Accordingly, CRM (NDPS) 1422 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
