1. We have heard Sri Kalyan Kumar Chakraborty, learned counsel for petitioner, Sri Dhiraj Trivedi, learned Deputy Solicitor General for Union of India/Railways and Sri Jahar Lal De, learned Additional Government Pleader for the State.

2. With the consent of the learned counsel for the parties, the matter is finally heard.

3. The principal grievance of petitioner was regarding non-starting of construction work of railway track from Dalkhola to Gazole via Raiganj-Itahar in the districts of Uttar Dinajpur and Dakshin Dinajpur of the State of West Bengal.

4. Sri Trivedi by placing reliance on his status report dated 23.12.2025 issued by Deputy Chief

Engineer/CON, N.F. Railway, New Jalpaiguri submits that no doubt, the project was earlier freezed but de-freezing had taken place, which is evident from the communication No.

W/98/CON/Misc.

Statement/320 dated 27.12.2025. Now the work started and the railway administration will try to complete it at the earliest. However, there are different agencies including State Government, whose cooperation is necessary.

5. Sri De submits that the State will act in accordance with law.

6. Since the grievance relating to de-freezing of project/establishment of rail line does not survive, we find no reason to keep this petition pending. We dispose of this petition by directing the respondents to complete the project at the earliest.

7. In the interest of justice, it is observed that in case there are any real hurdles in completion of project because of non-cooperation of any Government or its instrumentality, liberty is reserved to the petitioner to file a fresh petition.

8. With aforesaid, PIL is disposed of.

9. Urgent photostat certified copy of this order, if applied for, be furnished to the parties

expeditiously upon compliance of all legal formalities.
