In view of the innocuous nature of the order proposed, prior service of notice is not being directed on the Opposite Parties.

It is submitted by learned Counsel for the petitioners that the suit as well as the connected application under Order 1 Rule 10 of the Code of Civil Procedure are pending inordinately.

Since the suit was filed in the year 2017, there is substance in the contention of the petitioners. 4.

Accordingly, CO 3714 of 2024 is disposed of with a request to the learned Civil Judge (Senior Division), Ninth Court (I/C), Alipore, District- South 24 Parganas to dispose of Title Suit No. 423 of 2017 along with connected applications, if any, as expeditiously as possible. It is expected that the pending application(s) shall positively be disposed of

by February 28, 2025 and thereafter, the suit shall be disposed of within December 31, 2025.

The parties and all concerned shall act on the server copy of this order without insisting upon prior production of any certified copy for the purpose of compliance.
