Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 5 months and the deposition of the victim before the learned Trial Court is over. Learned advocate has also taken this Court to the evidence of the victim as well as the statement recorded under Section 183 of the BNSS, 2023.

Learned advocate appearing for the de facto complainant opposes the prayer for bail.

Learned advocate appearing for the State has produced the case diary and it reflects that the victim was

recovered from Pune. There is corroboration from the statement of the victim as well as the evidence which has been deposed in court.

Having regard to the manner in which the offence has been committed and the girl being of tender age, I am of the opinion that this is not a fit case for extending the privilege of bail to the petitioner. As such, the prayer for bail of the petitioner is rejected.

Case diary be returned to the learned advocate appearing for the State.

The application for bail, being CRM (M) 2292 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
