Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is going to organize Durga Puja for the first time at the location in question. The owner has given a "No Objection Certificate". An application was accordingly made to the Block Development Officer, Jhargram through the Inspector-in-Charge of Manikpara Beat House under the Jhargram Police Station. But the same has not been forwarded to the concerned BDO. Learned counsel for the State submits that the I.C, Jhargram Police Station found no document regarding the previous puja permission.

Old puja permission document can only be given if

there had been an old puja. This is an application for a new puja.

Therefore, the report appears to be misconceived to the above extent.

The contention of the State that no permission was to be given for a new puja had been set at naught by orders passed by the Single Bench of this Court as passed on 09.10.2012 in WP 22226 of 2012 and 18.10.2012 in WP 23392 of 2012.

Therefore, let the application made by the petitioner through the I.C. of the Manikpara Beat House under the Jhargram Police Station be forwarded by them to the BDO by 16.10.2023 upon which a decision shall be taken by the concerned BDO by 17.10.2023 and the result of the consideration shall be immediately communicated to the petitioner.

With these observations, the writ petition is disposed of.
