None appears for the private respondent despite service.

Learned counsel for the petitioner submits that the petitioner and the father of the private respondent are neighbours and by virtue of a registered agreement executed between them the private respondent's father was allowed to use a passage starting from the petitioner's property for the purpose of his egress and ingress. Now the private respondent is trying to obstruct the petitioner in using the said passage and is claiming absolute right over the same. The petitioner approached the Sub Divisional Officer, Contai in this regard wherein a report was submitted by the Block Land and Land Reforms Officer, Contai I to the effect that the private respondent had no right in the property in question. The Sub Divisional Officer directed the Inspector in Charge of the Contai police station to take necessary steps in terms of the report submitted by the Block

Land and Land Reforms Officer. The petitioner also approached the police authority for taking such steps but to no effect.

Since the police authority has failed to act in terms of the order passed by the Sub-Divisional Officer, Contai, the petitioner seeks liberty to approach the appropriate forum for redressal of his grievance. Such liberty is granted.

In the meantime, the police authority is directed to keep strict vigil in the area in order to avoid any untoward incident and to ensure maintenance of peace and tranquility.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
