Raju Viswakarma v. State Of West Bengal & ANR
23.09.2021 sb CRR 3386 of 2012 (Via video conference) In re : An application under Section 482 of the Code of Criminal Procedure, 1973.
In the matter of : Raju Viswakarma .......petitioners Mr. Imran Ali Ms. Debjani Sahu ....for the State The revisional application was preferred challenging the charge-sheet of Matigara Police Station case no. 63 of 2011 dated 3.3.2011 under Sections 363/366/366(A)/506 of the Indian Penal Code.
As none appears for the petitioner as also for the State, Ms. Sahu, learned advocate appearing on behalf of the State was directed to appear in this matter. Her appointment may be regularised by the concerned authorities. The investigating agency on conclusion of investigation submitted the charge-sheet before the jurisdictional Court under Sections 363/366(A)/506/376 of the Indian Penal Code. I have perused the statement under Section 164 of the Code of Criminal Procedure of the victim girl and I find that there are sufficient materials for the trial to be taken to its logical conclusion. As such no interference is called for at this stage.
Accordingly, CRR 3386 of 2012 is dismissed.
Pending application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
