03.12.2024 rc/ct.no.34 Item No.133 CRR No. 4509 of 2024 In the matter of : Swagata Mandal .......Petitioner Mr.Atis Kumar Biswas Mr. Amit Singh Mr. Rahul Soni ...for the Petitioner The petitioner seeks expeditious disposal of an application filed by him before the learned Chief Judicial Magistrate, Malda in G.R.Case No. 5402 of 2019 seeking return of the seized gold recovered in connection with the two (2) cases which are being dealt with analogously by the learned Magistrate, the cases being Malda Police Station Case No. 729 of 2019 dated November 21, 2019 and Malda Police Station Case No. 159 of 2020 dated March 07, 2020.

Learned counsel for the petitioner submits that the petitioner has produced all the relevant documents in support of his claim before the learned Magistrate with the application filed on July 20, 2023.

Since the application is pending for a considerable period of time, the learned Magistrate is directed to send the documents filed by the petitioner for verification to the Investigating Officer and call for a report within a reasonable time. The learned Magistrate shall consider and dispose of the application filed by

the petitioner upon receipt of such report within one month thereof.

CRR No. 4509 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
