Petitioner approached this Court in connection with Joynagar P.S. Case No.405 of 2013 dated 15.05.2013. The charges were framed on 29th December, 2016 as is revealed from the report submitted on behalf of the State. Learned trial court has already issued process for six witnesses and the next date is fixed on 12th April, 2024.

Learned trial court would henceforth fix one date in every fortnight for the purpose of the present case and if on three consecutive occasions any witness is absent, the learned trial court will close the evidence of the said witness with an option to State to produce the said witness at a later stage assigning reasons as to why the evidence of the said witness is required. All efforts be taken by the learned trial court to conclude a substantial portion of the

evidence of the prosecution by 31st December, 2024. In case the learned trial court finds that there is non-cooperation from Joynagar Police Station, notice be issued to the Deputy Superintendent of Police/SDPO-in-Charge of Joynagar Police Station who would take efforts for making the witnesses available on the date fixed by the learned trial court. No unnecessary adjournment be granted to either of the parties. Learned public prosecutor conducting the case would produce all the materials, documents and exhibits on the date so fixed for examination of the witnesses. The trial of the case would proceed in spite of any resolution of the local bar. All stakeholders would cooperate with the trial court to conclude the trial at the earliest. With the aforesaid observations, CRR 4183 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
