No. 29 CHC Rejected C.R.M.(A) 4839 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Islampur Police Station Case No. 211 of 2021 dated 24.04.2021 under Sections 363/365 of the Indian Penal Code read with Section 4 of POCSO Act.

And In the matter of : Mabarak Ali @ Mubarak Hussain ...... petitioner Mr. M. Nazar Chowdhury ...for the petitioner Mr. Bidyut Kumar Ray, Ms. Sima Biswas ....for the State Victim is a minor and recorded a statement under Section 164 of the Criminal Procedure Code implicating the petitioner in the incident of kidnapping and the allegations under the POCSO Act.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

This application for anticipatory bail is, thus, rejected. CRM(A) 4839 of 2023 is disposed of.
