Mr. Debashis Banerjee, Mr. Rakesh Jana, Mr. Purbayan Chakraborty, Advocates ... for the petitioners Mr. Brajesh Jha, Advocate ... for the UOI Mr. Jahar Lal De, Mr. Rudranil De, Advocates ... for the State In this public interest petition the petitioner, which is stated to be a Mazdoor Samity, has raised grievance that in the implementation of MGNREGA Project in district Purulia irregularities have been done and the workers, who have worked under MGNREGA Project, have not been paid their wages and such wages are now due since 26th December, 2021. Further grievance has been raised that no new work has been provided to the eligible workers. The details of such workers have been disclosed by way of supplementary affidavit.

It has been pointed out that the District Magistrate is the competent authority to look into this grievance, but in the representation which has been enclosed, no proper details of the affected workers have been mentioned.

Learned counsel for the petitioner has also raised a grievance that the irregularities exist not only in district Purulia but in the other districts also.

WPA (P) 578 of 2022 Having regard to the plea taken in the present petition and the stand of State, we dispose of the present petition by permitting the petitioner to file the detailed comprehensive representation along with the particulars of the affected/aggrieved workers before the District Magistrate, Purulia, who on receipt of the same will conduct an enquiry and will take appropriate action in accordance with law after giving an opportunity of hearing to all the concerned parties.

Let this exercise be completed within a period of three months from the date of receipt of the representation. In respect of other districts also, if the petitioner finds such irregularities, then he will be at liberty to file appropriate representation before the concerned District Magistrate.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
