Sl.14 14.11.2025 Court No.19 BP WPA 25562 of 2025 Sri Santanu Pattanayak & Anr.
-versus- The State of West Bengal & Ors.
Mr. Dilip Kumar Sinha ..for the petitioners Mr. Anand Farmania Mr. Uttam Kumar De ..for the State Mr. Debangshu Dinda ..for the private respondents The petitioners claim to be the owner of certain plots of land within Mouza Taragera in the District of Purba Midnapore by virtue of purchase for valuable consideration. The petitioners state that the private respondents have raised an illegal construction on the PWD roads which is lying adjacent to the property of the petitioners thereby causing obstruction to the ingress and egress of the petitioners from his property to the PWD roads.
The learned advocate appearing for the private respondents disputes the allegations made in the writ petition. However, since the petitioners have submitted a representation before the concerned authority praying for
removal of illegal and unauthorised encroachment on the public road, it is the duty of the respondent authorities to take steps in accordance with law.
Mr. Farmania, learned advocate appears for the State. He submits that necessary steps shall be taken by the concerned respondent within the time limit that may be fixed by this Court.
In the light of the submissions made by the learned advocates for the respective parties, WPA 25562 of 2025 stands disposed of by directing the Assistant Engineer, Public Works (Roads) Directorate, Tamluk Highway Division, Purba Medinipur to consider the representation of the petitioners and to take steps in accordance with law after giving an opportunity of hearing to the petitioners, the private respondents or any other person who may be affected by such order or their authorized representative and by passing a reasoned order which shall be communicated to the respective parties within a period of four weeks from the date of receipt of a server copy of this order.
