An accommodation has been sought for on behalf of the learned advocate appearing for the Municipality. As it appears that the writ petition is pending for a considerable period of time, accordingly, the Court is reluctant to adjourn the matter and dispose of the present writ petition on the basis of the documents available on record.

It has been submitted by the learned advocate appearing for the petitioners that a joint site inspection as directed by the Court was duly conducted.

A report of the joint site inspection as forwarded by the Municipality to the petitioners by communicating letter dated 7th February, 2023 has been produced before this Court. The same is taken on record.

It appears therefrom that the Municipality took note of the work performed by the petitioners apropos the work order issued.

The petitioners submit that no payment has been made by the Municipality on account of the work performed by the petitioners.

The representation of the petitioners praying for disbursement of the dues is pending consideration. In view of the above, the instant writ petition is disposed of by directing the Serampore Municipality to take steps to consider disbursal of the legal dues of the petitioners relying on the documents available with the Municipality and on consideration of the facts recorded in the joint site inspection report.

Effort shall be taken to disburse the admitted dues of the petitioners at the earliest, but positively within a period of four months from the date of communication of this order.

The amount which may appear to be not admitted by the Municipality, shall be clearly intimated to the petitioners along with reasons for not admitting the same.

It will be open for the petitioners to take appropriate steps in respect of the amount not admitted by the Municipality.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
