1. Counsel for the appellants submits that there is a fatal defect in the instant appeal and therefore, prays for withdrawal of the same with liberty to file afresh on the self-same cause of action.

2. In such view of the matter, the appellants are permitted to withdraw the instant appeal with liberty to file afresh challenging the self-same order in accordance with law.

3. There shall be, however, no order as to costs.

4. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
