1. By this public interest writ petition the petitioners seek for a direction to demolish a poultry firm, which, according to the petitioners, is constructed illegally.

2. The Sub-Divisional Officer, Rampurhat, Birbhum had passed an order which was challenged by the private respondent herein in WPA 26968 of 2024 and the writ petition is still pending and interim order is in force. In the said writ petition the present writ petition is the respondent no.6.

3. Since the matter is already seized of by the learned Single Bench, question of entertaining the writ petition as a public interest litigation would not arise.

4. Accordingly, the writ petition stands disposed of leaving it open to the writ petitioners to pursue their

remedies in the pending writ petition, namely, WPA 26968 of 2024.
