The petitioner is the widowed daughter of a deceased Assistant Teacher of Asadtala Binod Vidyapith, (H.S), Purba Medinipur.
The concerned teacher died-in-harness on October 10, 1980, on his death, the mother of the petitioner used to receive the family pension, she has also died.
The petitioner is now praying family pension. Mr. Halder, learned Counsel for the State submits that the petitioner is entitled to the family pension as prayed for subject to fulfillment of the conditions necessary to get such pension but to process her prayer she is required to file some documents and the District Inspector of Schools (S.E) Purba Medinipur, the respondent no. 3 herein, has requisitioned the said documents from
the petitioner through the school. He files a report of the respondent no. 3 dated December 5, 2023, let it be kept with the record.
The petitioner is directed to contact the school to submit the necessary papers. The respondent no. 3, within a period of four weeks from the date of receipt of the said papers, shall process the prayer for family pension and shall communicate his decision to the petitioner.
W.P.A. 24805 of 2023 is disposed of with the above terms without any order as to costs.
Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
