Learned counsel for the appellant submits that the appellant (writ petitioner) had never agreed to pay the said amount. If that is so, then the proper remedy available to the appellant is to file an appropriate application before the learned Single Judge seeking review/modification of the order under appeal. In view of this, learned counsel for the appellant seeks permission to withdraw this appeal with liberty to file an appropriate application before the learned Single Judge.

The appeal is dismissed as withdrawn with liberty as prayed for.
